Terms of Service

By booking a service with Caliche Dumpster Rental, you agree to the following terms. Please read them before confirming your rental.
1. Rental Agreement
Your rental begins at the time of container delivery and ends when we pick up the container. The rental period, price, included weight limit, and overage rates are confirmed verbally or in writing before delivery. These terms do not change after confirmation.
2. Permitted and Prohibited Materials
You may place general household and construction debris in our containers as listed on our website. The following are strictly prohibited and will result in additional fees or container refusal at the disposal facility: hazardous waste, paint and solvents, tires, batteries, electronics with screens, medical waste, propane tanks, motor oil, refrigerants, asbestos, or any liquids. If prohibited materials are found in your container, you are responsible for all costs associated with proper disposal, including any fees charged by the SCSWA facility or third-party hazardous waste handlers.
3. Weight Limits and Overages
Each container size includes a weight limit confirmed at booking. If your load exceeds the included limit, overage charges of $60 to $80 per additional ton apply. Overages are calculated using the actual landfill scale ticket — not estimated. You will be notified of any overage before you are billed.
4. Placement and Permits
You are responsible for ensuring that the placement location is legal and accessible. If a City of Las Cruces permit is required for street placement, you are responsible for obtaining it before delivery. We will advise you on permit requirements based on your address, but final responsibility for compliance rests with you. We are not liable for any fines or penalties resulting from placement without a required permit.
5. Container Loading
The container must not be loaded above the top rail. Overfilled containers cannot be safely transported and we reserve the right to refuse pickup until excess material is removed. You are responsible for any costs associated with material removal from an overfilled container.
6. Liability
We are not responsible for damage to driveways, surfaces, or landscaping caused by normal container delivery and pickup operations. If you have concerns about driveway surface fragility, notify us at booking and we can advise on protective measures. We are not liable for third-party dumping in your container during your rental period — you are responsible for the contents of the container throughout the rental.
7. Governing Law
These terms are governed by the laws of the State of New Mexico. Any disputes arising from this agreement shall be resolved in Doña Ana County, New Mexico. For questions, contact us at info@dumpsterrentallascruces.com or (575) 319-8484.
